Did the credit agency take funds from my bank account illegally?
Hello all,
I had a gym membership that lapsed. I signed in my contract that the gym could deduct my monthly dues, via "CheckFree," an automated service. In December '07, I lost my job and it did not have sufficient funds when it was deducted. The gym sent me to these National Credit b*stards and they have been mailing me monthly coupons, which I've been paying up until last month.
I was sent two coupons and was coming up on 30 days late. I came across a bank account debit for the past month and current month which wasn't even due yet! I called this pr*ck and he told me since I signed up with CheckFree with the gym, they can take it out. Then, "Justin" actually hung up on me!!!
So, is this legal? I felt it wasn't because the gym stopped using the automated service and it shouldn't transfer over to the credit agency. I know the big picture is to pay my bills on time, but I lost my job so go easy.

This is what you need to do, Go to your bank and stop any debit or checks coming from your account. It may cost you anywhere from $35 to $50 but is is effective. I live in one of the hardest hit Mississippi cities that Hurricane Katrina hit. I also had a gym membership. The gym was out of commission for over 7 months due to Katrina but they continued to take the money out of my account. I did not realized due to what was happening until I started getting my mail delivery again. If you had paid by credit card it would have been easy to stop it. If you use debit or checks it is a continual thing with them. They don't care one way or the other if you lost your job or a disaster hits. They just want your money.
***The membership just passed you over to a credit agency. They can do this if its in your contract.
***Whileisa and some of the other poster are wrong. You do not have to shut down or close you account. Writing a letter does nothing either. You need to go to your bank an personally stop that (one) debit from coming out again in the future. Like I said it cost anywhere from $35 to $50 to do this.
